Terms of Use

Chapter 1 General Provisions

Article 1 (Purpose)

  • These terms and conditions are intended to regulate the rights, obligations, responsibilities, and other necessary matters between the Busan Economic Promotion Agency (hereinafter referred to as the “Promotion Agency”) and its members in using the web service (hereinafter referred to as the “Service”) provided by the Agency.
  • Personal authentication information based on email authentication: Personal identification for service use, provision of integrated authentication service
  • Information using social networking service (SNS: Google, Facebook, Twitter, Kakao, Naver, etc.) authentication: For the purpose of providing self-identification and integrated authentication services according to service use
  • Email, mobile phone number: To ensure smooth communication channels such as delivering notices and handling inquiries, providing services, providing content, providing customized services, etc.

Article 2 (Definition)

The definitions of terms used in these Terms and Conditions are as follows

  • userA person who receives services provided by the Promotion Agency in accordance with these Terms and Conditions
  • Service AgreementAgreement between the Promotion Agency and the user regarding use

Article 3 (Effectiveness and Change of Terms and Conditions)

  • These terms and conditions are made public to users by posting them on the service screen or notifying them through other means, and they become effective when users who agree to them sign up as members.
  • The Promotion Agency may change the contents of these Terms and Conditions if it deems it necessary. The changed Terms and Conditions will be posted on the service screen, and if you continue to use the service without expressing your intent to reject within 7 days of the posting, you will be deemed to have agreed to the changes in the Terms and Conditions.
  • If a user does not agree to the changed terms and conditions, he or she may discontinue use of the service and cancel his or her membership. If the user continues to use the service, he or she will be deemed to have agreed to the change in terms and conditions, and the changed terms and conditions will take effect in the same manner as the preceding paragraph.

Article 4 (Applicable Provisions)

Matters not specified in these Terms and Conditions shall be governed by the provisions of the Framework Act on Telecommunications, the Telecommunications Business Act, and other relevant laws and regulations.

Chapter 2 Service Use Agreement

Article 5 (Establishment of Use Agreement)

The service agreement is established through the user member’s application for use and the Promotion Agency’s approval of the application.

Article 6 (Application for Use)

To apply for membership, users can fill out the membership application form requested by the Promotion Agency on the service's member information screen and enter their personal information.

Article 7 (Approval of application for use)

  • If a member applies for service use by accurately filling in the information specified in the application form in Article 6, the application for service use will be approved unless there are special circumstances.
  • In the following cases, approval may be withheld or use of some services may be restricted until the reasons for the restriction on the application are resolved.
  • If the content is found to be false (using a false name, anonymity, or using an identity verification account, etc.) or if there is reasonable cause to suspect it to be false
  • In cases where the Promotion Agency deems it necessary for public interest
    • In the following cases, consent to use may not be granted.
    • When you did not apply under your real name
    • When applying using someone else's name
    • When the application for use contains false information or is used for the purpose of disturbing public peace, order, or public morals
    • When the application requirements set by other promotion agencies are not met

Article 8 (Changes to contractual terms)

Members can view and edit their information at any time through member information management. Members must edit information provided at the time of application for use if it has changed. Members are responsible for any problems that arise from failure to edit information.

Chapter 3 Service Provision and Use

Article 9 (Service Use)

  • The Promotion Agency will begin providing services once it has approved the member's application for use. However, for some services, the service will begin from a specified date.
  • If the service cannot be provided due to operational or technical issues at the Promotion Agency, this will be posted on the website or notified to members.
  • The service is available 24 hours a day, 365 days a year in principle. However, the service may be temporarily suspended for operational reasons such as regular maintenance, or for a period determined by the Promotion Agency. In such cases, the Promotion Agency will provide notice in advance or after the fact.
  • Even after you sign up for membership, some services may only be available to certain members.
  • The Promotion Agency may divide the service into certain ranges and set separate availability times for each range. In this case, the details will be announced in advance.

Article 10 (Changes, suspension of services, and storage and use of information)

  • The Promotion Agency shall not be liable for any loss of communication data, including messages and other communication messages stored or transmitted on this service, if such messages are not stored or deleted, are not transmitted, or are otherwise lost due to a national emergency, power outage, service equipment failure beyond the scope of the Promotion Agency's control, or other force majeure.
  • In the event that the Promotion Agency must temporarily suspend the service due to difficulties in providing normal services, the service may be suspended after providing notice one week in advance of the suspension, and the Promotion Agency shall not be liable for the member's failure to recognize the notice during this period. In special circumstances, the above-mentioned advance notice period may be shortened or omitted. In addition, the Promotion Agency shall not be liable for the failure to store or delete, failure to transmit, or other loss of communication data stored or transmitted in this service due to the above-mentioned suspension of service.
  • In the event that the service must be permanently discontinued due to circumstances at the Promotion Agency, Article 2 shall apply. However, in this case, the advance notice period shall be one month.
  • The Promotion Agency may temporarily modify, change, and suspend the service after prior notice, and shall not be liable to members or third parties for this.
  • If a member violates the terms and conditions of this agreement, the Promotion Agency may suspend the member's use of the service at its discretion. In this case, the Promotion Agency may prohibit the member's access and delete all or part of the content posted by the member at its discretion.
  • If you are a long-term inactive member, your use of the service may be suspended after a one-week notice period following the issuance of a notification email or announcement.

Article 11 (Provision of information and posting of advertisements)

  • The Promotion Agency may provide members with various information and advertisements that it deems necessary while using the service via e-mail, postal mail, SMS (mobile phone text message), DM, messenger, etc. If a member receives unwanted information, he or she may refuse to receive it.
  • The Promotion Agency may post advertisements, etc. on service screens, homepages, e-mails, etc. in relation to the operation of the service, and the Promotion Agency considers that members who wish to use the service agree to the posting of such advertisements.
  • The Promotion Agency is not responsible for any loss or damage that occurs as a result of a member's participation in promotional activities with advertisers posted on the service or through the service, or as a result of communication or transaction.

Article 12 (Deletion of posts or contents)

  • The Promotion Agency may delete any content posted or registered by members within the service without prior notice if it determines that such content falls under any of the following items, and the Promotion Agency shall not be held liable in any way for this.
    • In case of violation of another person's rights, such as invasion of privacy or defamation
    • In case of content that violates public order and morals
    • If the content is deemed to be related to criminal activity
    • In case of content that infringes on the copyrights or other rights of a third party
    • In case of information that does not match the nature of the service
    • In case of violation of other related laws and regulations established by the Promotion Agency, etc.
    • If the posted content violates these terms and conditions or is commercial, illegal, or unhealthy.
  • The Promotion Agency reserves the right to edit or move content posted on the service after three days from the date of prior notice.
  • If the posted content has lost its effect as a posting after a certain period of time or the purpose of posting has become unclear, the Promotion Agency may delete the posting after a one-week notice period following the announcement of the notice.

Article 13 (Copyright of Posts)

  • The copyright of posts made by members within the service belongs to the members, and the Promotion Agency may use them, such as by posting them in other services.
  • Any civil or criminal liability arising from a member's posting infringing upon another person's copyright, program copyright, etc. shall be borne entirely by the member.
  • Members may not use materials posted on the service for commercial purposes, such as processing or selling information obtained through the use of the service.

Article 14 (Promotion Agency’s Ownership)

  • Intellectual property rights and other rights related to the services provided by the Promotion Agency, the necessary software, images, marks, logos, designs, service names, information, and trademarks are owned by the Promotion Agency.
  • Except in cases where the Promotion Agency has expressly approved, you may not modify, rent, loan, sell, distribute, produce, transfer, sublicense, establish a security interest in, or commercially use all or part of the properties specified in Paragraph 1, and you may not allow third parties to do the same.

Chapter 4 Obligations of the Contracting Parties

Article 15 (Obligations of members and non-members and information security)

  • When registering to use the service, members must provide complete information (hereinafter referred to as “registration information”) that is current and accurate. In addition, if there is a change in registration information, the information must be updated immediately.
  • When a member completes the registration process to use the service, he or she will receive an ID and PASSWORD.
    • The Promotion Agency is not responsible for any damages resulting from loss of member ID or PASSWORD.
    • Members must log out after each session.
  • Members and non-members may not perform the following actions while using the service.
    • Acts that cause harm to others (including minorities)
    • Stealing another person's ID, PASSWORD, or personal identification account, or impersonating another person
    • Acts of falsely stating one's relationship with another person
    • An act of defaming another person by writing true or false facts with the purpose of slandering that person
    • An act of distributing false information for the purpose of providing financial benefits to oneself or others or causing damage to others.
    • An act of interfering with the other person's daily life by continuously sending words, sounds, texts, images or videos that cause shame, disgust or fear to the other person.
    • Profit-making activities using the service without prior approval from the Promotion Agency
    • An act of using another person's information and communication service user name without permission
    • Posting or e-mailing any unnecessary or unauthorized advertising, promotional materials, or soliciting any “junk mail,” “spam mail,” “chain letters,” “spam posts,” or “pyramid schemes.”
    • Posting, publishing or sending by e-mail low-speed or obscene data, text, software, music, photos, graphics, video messages, etc. (hereinafter referred to as "content") - Posting, publishing or sending by e-mail content to which you do not have the rights (all rights including intellectual property rights)
    • Posting, publishing or sending by e-mail software, etc. that is intended to destroy, interfere with or limit the functionality of computer software, hardware or telecommunications equipment.
    • Acts of collecting or storing personal information of other users, such as posting, publishing, or sending by e-mail materials containing other computer codes, files, or programs.
    • An act of gambling or speculation involving money
    • An act of distributing information that promotes prostitution or mediates sexual intercourse.
    • Other illegal or unfair acts
  • Members must comply with the provisions of these Terms and Conditions and related laws and regulations.
  • The Promotion Agency shall not be liable for any damages resulting from any act falling under any of the provisions of Article 15, Paragraph 3, and the person causing the damages may be punished in accordance with relevant laws and regulations.

Article 16 (Duties of the Promotion Agency)

  • Unless there are special circumstances, the Promotion Agency will ensure that the service requested by a member is available within one working day.
  • The Promotion Agency has an obligation to provide services continuously and stably in accordance with the provisions of these Terms and Conditions.
  • If damage occurs to a member due to a service provided by the Promotion Agency, the Promotion Agency shall be liable only if such damage is caused by the Promotion Agency's intent or gross negligence, and the scope of such liability shall be limited to normal damages.
  • If the Promotion Agency determines that opinions or complaints raised by members are justified, it must process them promptly. However, if prompt processing is difficult, the Agency must notify the member of the reason and processing schedule.
  • The Promotion Agency strives to protect the personal information of members, including member registration information, in accordance with the relevant laws and regulations. Regarding the protection of members’ personal information, the relevant laws and regulations and the provisions set forth in Article 17 are observed.

Article 17 (Personal Information Protection Policy)

  • The Promotion Agency collects information about members through the information provided by members when registering for membership or applying for service use, and uses the members' personal information for the purpose of executing this agreement and providing services under this agreement.
  • The Promotion Agency may not disclose or distribute member information acquired in relation to the provision of services to a third party without the member’s consent, and may not use the information for commercial purposes. However, this does not apply in the following cases:
    • When there is a request from a relevant agency for investigative purposes in accordance with relevant laws and regulations
    • When requested by the Information and Communications Ethics Committee
    • In case of a request in accordance with the procedures stipulated in other related laws and regulations

Chapter 5 Termination of Contract

Article 18 (Contract termination and usage restrictions)

  • When a member wishes to terminate the service agreement, the member must personally submit a termination request to our website via the Internet.
  • The Promotion Agency may request or restrict changes to a member's ID and PASSWORD for reasons such as security and ID policy, and smooth provision of services.
  • If a member commits any of the following acts, the Promotion Agency may terminate the service agreement or restrict use without prior notice.
    • In cases where data provided by members or non-members is found to be false, such as through non-real-name registration or theft of a real-name verification account.
    • In case of involvement in criminal activity
    • When planning or executing use of the service for the purpose of harming national interests or public interests
    • If you steal someone else's service ID and password
    • In case of damaging or causing disadvantage to another person’s reputation
    • If the same user registers twice with different IDs
    • In case of hindering sound use of the service, such as causing damage to the service
    • In case of violation of other related laws or terms of use established by the Promotion Agency

Chapter 6 Others

Article 19 (Fees and Fee Information)

The use of the service is basically free. However, this does not apply to separate paid information and paid services specified by the service.

Article 20 (Prohibition of Transfer)

Members may not transfer or donate their right to use the service or other contractual status to others, and may not provide this as collateral.

Chapter 7 Compensation for damages, etc.

Article 21 (Compensation for damages)

The Promotion Agency shall not be liable for any damages suffered by members in connection with services provided free of charge, except in cases where such damages are caused by gross negligence on the part of the Promotion Agency.

Article 22 (Exemption Clause)

  • If the Promotion Agency is unable to provide services due to a natural disaster or other force majeure, it will be exempt from responsibility for providing services, notwithstanding the provisions of Article 21.
  • The Promotion Agency is not responsible for any service disruption caused by the member's fault.
  • The Promotion Agency is not responsible for any losses incurred by members due to benefits expected from using the service or information obtained through the service.
  • The Promotion Agency is not responsible for the reliability, accuracy, etc. of information, data, and facts posted by members on the service.

Article 23 (Jurisdiction)

  • If a dispute arises in connection with the use of the service, the Promotion Agency and the member must make all necessary efforts to amicably resolve the dispute.
  • Notwithstanding the provisions of Paragraph 1, in the event of a lawsuit arising from a dispute over the use of the Service, the court with jurisdiction over the location of the Promotion Agency shall be the court of jurisdiction. Supplementary Provisions These Terms and Conditions shall be effective from April 11, 2018.

  • Retention and use period of personal informationThe Busan Economic Promotion Agency will retain and use the user's personal information only for the period during which the service is provided from the date of membership registration.
  • If you request withdrawal of membership or withdraw consent to the collection and use of personal information, the personal information will be destroyed without delay when the purpose of collection and use is achieved or the retention and use period ends.

  • Notice of right to refuse consent
  • Anyone can refuse to consent to the Busan Economic Promotion Agency membership by selecting the refuse consent button. If you refuse consent, you will not be able to register as a member due to insufficient information for basic activities as a member, and accordingly, member login and use of member services through the website will be restricted.

Terms of Use

  • All personal information handled on the website of the Busan Economic Promotion Agency (hereinafter referred to as the “Promotion Agency”) is collected, retained, and processed based on relevant laws and regulations or with the consent of the information subject.

The personal information being processed will not be used for purposes other than the following, and if the purpose of use changes, necessary measures such as obtaining separate consent in accordance with Article 18 of the Personal Information Protection Act will be implemented. Our site collects the minimum amount of personal information in accordance with the provisions of the “Terms of Use” for the purposes of providing services, handling complaints, and performing relevant tasks.

Article 2 (Processing and retention period of personal information)

Article 3 (Items of personal information processed)

  • The Promotion Agency collects and processes the minimum amount of information necessary for the purpose of collecting and retaining personal information.
  • When using the Promotion Agency website service, personal information items such as IP address, cookies, MAC address, service usage history, visit history, and improper usage history may be automatically generated and collected.

Article 4 (Provision of personal information to third parties)

In principle, the Promotion Agency processes the personal information of the data subject within the scope of the purpose of collection and use, and does not process or provide it to a third party beyond the original purpose without the prior consent of the data subject, except in the following cases.

  • In case separate consent is obtained from the data subject
  • In cases where there are special provisions in other laws
  • In cases where the data subject or his/her legal representative is unable to express his/her intention or where prior consent cannot be obtained due to unknown address, etc., and it is deemed necessary to protect the urgent life, body, or property interests of the data subject or a third party
  • In cases where personal information is provided in a form that does not allow the identification of specific individuals, such as for purposes such as compiling statistics or conducting academic research.
  • In cases where personal information cannot be used for purposes other than the intended purpose or provided to a third party, and where the relevant duties stipulated in other laws cannot be performed, and where the deliberation and opinion of the Protection Committee have been obtained.
  • When necessary to provide information to foreign governments or international organizations for the implementation of treaties or other international agreements.

Article 5 (Entrustment of personal information processing)

  • When entrusting personal information processing work, the Promotion Agency processes it by specifying the following matters in a contract (agreement) document, and provides education and management supervision to ensure that the recipient safely processes personal information.

    6. 6.Matters related to supervision, such as checking the status of management of personal information held in relation to entrusted work
    7. 7.Matters concerning liability, such as compensation for damages, in case of breach of obligations that the trustee must comply with
  • The Promotion Agency has entrusted personal information processing work to ensure smooth processing of personal information, and the status is as follows.
  • If the content of the entrusted work or the trustee changes, we will disclose it without delay through this personal information processing policy.

Article 6 (Measures to ensure personal information security)

The Promotion Agency is taking the following measures to ensure the safety of personal information.

  • Establishment and implementation of an internal management plan for safe handling of personal information
  • Establish and implement an access rights management plan for the personal information processing system.
  • Establish and implement measures to prevent illegal access and intrusion incidents through information and communication networks.
  • Encryption of unique identification information, passwords, and biometric information when transmitted or stored via information and communications networks
  • Records of personal information handlers accessing the personal information processing system are kept for at least 6 months and are regularly inspected.
  • Installation and update of security programs for personal information
  • To prevent personal information breaches such as personal information leaks, restrict terminal access and install security programs.
  • Access control to physical locations where personal information is stored, such as data centers, archives, and computer rooms
  • Establishment of response procedures such as crisis response manuals to protect personal information processing systems in preparation for disasters and calamities, and regular inspections
  • In the event that a reason for destruction arises, such as the expiration of the personal information retention period, the information is completely destroyed so that it cannot be restored.

Article 7 (Installation, operation and refusal of automatic personal information collection devices)

  • The Promotion Agency uses 'cookies' to store and periodically retrieve website usage information in order to provide personalized services to website users.
  • Cookies are small files of information that are stored on a user's computer by the website's server when the user visits the website.
    1. 1.Purpose of cookie use: To provide optimized information to users by identifying the visit and usage patterns, popular search terms, and whether or not the access is secure for each service or website visited by the user.
    2. 2.Cookie installation/operation and rejection: You can reject cookie storage by setting options in the Tools>Internet Options>Privacy menu at the top of the web browser.
    3. 3.If you refuse to store cookies, you may experience difficulties using customized services.
    4. 4.Cookies expire when you close your browser or log out.

Article 8 (Destruction of personal information)

  • When personal information becomes unnecessary, such as when the retention period for personal information expires or the processing purpose is achieved, the Promotion Agency destroys the personal information without delay.
  • In cases where the retention period of personal information for which consent has been given by the data subject has expired or the purpose of processing has been achieved, but the personal information must be retained in accordance with other laws and regulations, the personal information (or personal information file) is transferred to a separate database (DB) or stored in a different location.
  • The procedures and methods for destroying personal information are as follows
    1. 1.Destruction Procedure: The Promotion Agency selects personal information for which a reason for destruction has occurred, establishes a destruction plan, and destroys the personal information after receiving approval from the Personal Information Protection Officer. After the destruction of personal information is carried out, the Personal Information Protection Officer verifies the results of the destruction and prepares a personal information file destruction management ledger.
    2. 2.Destruction Method: The Promotion Agency destroys personal information recorded and stored in electronic file formats by making the records unrecoverable, and destroys personal information recorded on paper documents by shredding or incinerating them.

Article 9 (Rights and obligations of data subjects and legal representatives and methods of exercising them)

  • The data subject may exercise his/her rights to request the Promotion Agency to view, correct, delete, or suspend the processing of his/her personal information.
  • The rights under Article 1 may be exercised by filling out the form in Appendix 8 of the Enforcement Regulations of the Personal Information Protection Act and submitting it in writing, by e-mail, fax, etc., and the Promotion Agency will take action on it without delay.
  • The rights under Article 1 may be exercised through a proxy, such as the data subject's legal representative or authorized person. In this case, a power of attorney in the format of Appendix 11 of the Enforcement Regulations of the Personal Information Protection Act must be submitted.
  • Requests to view or suspend processing of personal information may limit the data subject's rights under Article 35, Paragraph 5 and Article 37, Paragraph 2 of the Personal Information Protection Act.
  • Requests for correction or deletion of personal information cannot be made if the personal information is explicitly stated as a collection target in other laws.
  • When requesting access, correction/deletion, or suspension of processing in accordance with the information subject's rights, the Promotion Agency verifies whether the person making the request is the information subject or a legitimate agent.

Article 10 (Changes to Personal Information Processing Policy)

The information subject may request access to personal information from the Promotion Agency to the department below, and the Promotion Agency will endeavor to ensure that the information subject's request to access personal information is processed promptly.
